License Agreement

This End-User License Agreement (the "EULA") governs the use of modules, their updates, upgrades, and associated services (the "Product") currently or in the future provided by cibeo-software.com (collectively referred to as "cibeo-software").

The EULA defines the terms of access and use of the Products provided to you by cibeo-software, whether you are the User ("You"). The cibeo-software Privacy Policy (available at https://www.cibeo-software.com/r/content/2-mentions-legales) is an integral part of this EULA. By installing or using the Product, you agree to comply with and be bound by both the EULA and the Privacy Policy. If you do not agree with either of these, please do not install or use the Product.

If you have a cibeo-software account accessible at https://www.cibeo-software.com ("Terms and Conditions"), the EULA will coexist with these Terms and Conditions without replacing them. In the event of a conflict between the terms of this Agreement and the Terms and Conditions, the provisions of the Terms and Conditions shall prevail.

Grant of License

Cibeo-software (or its licensors) grants you a personal, non-exclusive, non-transferable, non-sublicensable, and non-commercial license to install and/or use the Product (in whole or in part), as well as any other Product (the "License"), for a determined period, until either you or cibeo-software decide to terminate this EULA. You agree not to use, nor allow others to use, the Product or this License for commercial purposes, unless you obtain a specific commercial license from cibeo-software. Updates, upgrades, and modifications may be required to continue using the Product on certain platforms.

Where applicable, the Product may include third-party features managed by external providers, which may be subject to additional terms or costs. You must comply with these additional terms. For example, if the Product includes a social media login feature, you will need to adhere to the Terms of Use associated with the corresponding API. Please carefully review these terms and additional costs.

It is prohibited, either directly or indirectly, to sell, rent, lend, license, distribute, market, or exploit the Product or any part of it commercially, to reverse engineer, decompile, disassemble, adapt, reproduce, or create derivative works of the Product (unless a specific feature allows for user-generated content, in which case you must create an account and comply with the Terms and Conditions), to remove, modify, or bypass any copyright notice, trademark, or other legal information present in the Product, and to export or re-export the Product or any copy in violation of applicable laws or regulations.

By using the Product, you agree to comply with all applicable laws, rules, and regulations. You may only use the Product in accordance with its intended use.

Here are some non-exhaustive examples of prohibited conduct:

Creating, using, sharing, or publishing any content (text, images, sounds, videos, etc.) in connection with the Product that violates confidentiality obligations, infringes intellectual property or privacy rights, or encourages illegal activities (e.g., hacking, distribution of counterfeit software).
Propagating viruses, trojans, worms, logic bombs, corrupted files, or other harmful devices via the Product, or participating in attacks on cibeo-software's servers, the Product, or its service providers and partners.
Creating, providing, or using alternative methods of accessing the Product, such as server emulators.
Spamming the chat, whether for personal or commercial purposes, by disrupting the conversation with repetitive, similar messages.
Transmitting or sharing content deemed offensive by cibeo-software, including but not limited to harmful, threatening, abusive, defamatory, obscene, sexually explicit, or discriminatory language based on race, ethnicity, or any other characteristic.

Ownership

All titles, ownership rights, and intellectual property rights related to the Product (including, without limitation, all texts, graphics, messages, information, as well as any other element making up the Product, whether individually or combined) and all copies thereof are the exclusive property of cibeo-software or its licensors.

This license does not grant you any ownership rights in the Product and should not be interpreted as a sale of rights related to the Product.

Disclaimer of Warranty and Limitation of Liability

You expressly acknowledge that the use of the Product is at your own risk. To the fullest extent permitted by applicable law, the Product is provided "as is" and "as available." Cibeo-software and its associated service providers make no warranty, condition, or representation, whether express, implied, statutory, or otherwise, including but not limited to: its compliance, accuracy, completeness, reliability, or security; its suitability for a particular use; implied warranties of title and non-infringement; (d) its merchantability; or your satisfaction. Cibeo-software does not warrant that the Product will be uninterrupted or error-free, that defects will be corrected, or that the Product is free from viruses or other harmful components. You assume full responsibility for selecting the Product to achieve the desired results, as well as for its installation, use, and the results obtained.

Notwithstanding the above liability limitations, your sole remedy in the event of a dispute with cibeo-software or its licensors, distribution partners, and associated service providers is to cease using the Product. In the case of a Product purchased for use on a compatible device that does not meet applicable legal warranties, Cibeo-software's liability is limited to a refund (directly or indirectly, through its distribution partners or service providers) of the purchase price of the Product.

Termination

The EULA takes effect from the date you purchase, download, or use the Product, and remains in effect until terminated in accordance with its terms.

You and Cibeo-software (or its licensors) may terminate this EULA at any time, for any reason. Termination by Cibeo-software will be effective when you are notified, when your Cibeo-software account is terminated (if applicable), or when Cibeo-software decides to stop offering and/or supporting the Product.

This EULA will be automatically terminated if you fail to comply with any of its terms. In the event of termination for any reason, you must immediately uninstall the Product and delete all copies in your possession. Termination for any of these reasons does not entitle you to a refund.

Modifications to this EULA or the Product

Cibeo-software reserves the right, at its sole and absolute discretion, to revise, update, modify, change, add, supplement, or remove certain terms of this EULA for security, legal, best practices, or regulatory reasons. These modifications will take effect with or, if necessary, without prior notice.

You can review the most recent version of this EULA by clicking the "License Agreement" link on www.cibeo-software.com. It is your responsibility to periodically check for any modifications to the EULA. If future modifications to the EULA appear unacceptable or cause you to no longer agree with or comply with the EULA, you may terminate this EULA in accordance with Section 4. In that case, you must immediately uninstall the Product and destroy all copies of the Product.

Your continued use of the Product after any revision of the EULA constitutes your full and irrevocable acceptance of all such modifications.
